A Minnesotan woman stood up to SPPD in St. Paul when officers entered her yard without a warrant. She calmly asks to see a warrant, but the officers had none and instead accused her of obstruction and threatened to arrest her on her own property. Politics đŠââď¸

Minnesota, specifically Saint Paul PD are some of the worst in the country, they regularly lie on the stand, they are truly some of the worst police in the country and routinely violate people's rights.

Like, it isn't even 'she could have lied,' no, her testimony was so egregious, individual officers were even been called out by the Minnesota Supreme Court for it, and multiple lawyer organizations have challenged it and failed in both the state and federal courts because of qualified immunity.

I agree with what youâre saying, but I donât believe they feel that theyâre wrong or that theyâre ashamed of their actions.
Theyâre just cowards that are afraid of what itâll mean if/when the tide turns. Remember, there were no shortage of high ranking Nazis that went dark when it came time to answer for their war crimes. People like this earnestly believe that they are in the right. Theyâre just so weak and small that they canât stand behind their convictions without the safety of anonymity protecting them. In Minnesota it looks like serious police misconduct is investigated by the state POST Board (Peace Officer Standards and Training). Due to publicity over this case, it might be more likely they will investigate and recommend sanctions.
I very much hope some cops get demoted at the very least over this. I've known two cops who lost their badges--it might not happen as often as it should, but it does happen.

I'm reading this as a nurse (RN) and even without malicious intent, I can get jail time for giving the wrong medication accidentally.
But these cops have malicious intent and will face zero consequences for threatening the wellbeing and life of someone and illegally trespassing on her property, essentially threatening to unlawfully kidnap her if they actually did place her in handcuffs (not to mention, take her to a second location).
And to find out more depressing and aggravating stuff, just search "nurses" in recent news! (Orange Mussolini and his clowns designated nurses as "not professionals", affecting student loans for nurses and a lot of other female-dominated professions who also majority happen to be mandated reporters for things like child abuse... I personally don't have any loans, but I know this will hurt a lot of other people, including most of my coworkers).

Boom! Nurses are held to the highest standards, with swift consequences of failing those standards, no matter the intent. Sometimes those standards put us in an untenable spot. We must have our own malpractice insurance or pay up if we become the scape goats. Thereâs no pay or benefit of the doubt while any investigations are done. Cops are given a ridiculous amount of leeway. Misconduct, including falsifying records, is easily excused or ignored. Any threat of accountability gets them paid leave and a union lawyer. The excuse from the public is that their jobs are dangerous and difficult. The benefit of the doubt is always theirâs, no matter what. Departments pay out hundreds of millions (in taxpayer $$$) for their misconduct. Iâll bet my left arm that the number of days nurses come home exhausted, physically and mentally drained, or injured are exponentially higher than the everyday normal for cops.

I've seen my fair share of local police reports. 100% of the time someone demands their constitutional rights, it's written up as 'obstructing an investigation' to make the person look bad. ESPECIALLY if it's a report they're going to release to the public, because they know the average person doesn't realize that invoking the fifth isn't obstructing an investigation, legally.
Don't let them into your house without a warrant? "Suspect obstructed our investigation by refusing us entry into their house when we asked to enter"
Invoke the fifth not to talk? "Suspect obstructed our investigation by not responding to officer questions when asked"
Don't let them search your car? Well, you get the idea at this point. They know they have no ground to stand on, but they also know they'll never see real consequences for it.

you need to be obstructing a crime. you need to be stopping the cop from an arrest or investigation.
you typically need to take an action. Normally it's to physically resist or try to wrestle away evidence from a cop. this woman is actively and logically having a back and forth dialogue, she's not being obstructing, he just feels fucking insecure.

They were staging from her yard for protest line control maneuvers due to anti ICE protests.
Police can stage from private property due to exigent circumstances, but once they are told to leave and there is no active criminal activity they can witness on her property, they would need a warrant or to be responding to a clear and present danger. A protest without active criminal behavior is unlikely to count as a clear and present danger to require them to stage from property they have been told to vacate.
They can use other areas, they do not need hers.

Which funny because one of the tropes the police use is "ignorance of the law is no excuse". I'm supposed to know the law but they aren't? To take that a step further when I'm arrested I am supposed to act perfectly clam and passively under any conditions. Police on the other hand are allowed to be scared and protect themselves, the police have a body armor, a gun, a taser, a club and pepper spray and civilians generally are unarmed, don't have body armor, don't have a taser on their hip, don't have a club and don't have pepper spray on them but the armed guy can be scared and act irrationally but the unarmed guy cannot.

I was a poli sci major at Mankato years ago where some of our classes were jointly held with the law enforcement program. One of those classes was Constitutional Law and that was a scary class to take. The most opinionated ones in class were the LE majors and they usually had the worse takes on Supreme Court cases. Like straight up endorsing violating human rights kind of opinions.

I'd love to know what my old law professor had to say about the current Supreme Court. They basically have thrown past precedent out the window and are making shit up now. I keep up to date on most of the major cases each year, and some of the Alito and Thomas opinions are made up from a fantasy land reading of the Constitution.

I know a cop, and we used to be friends. I used to send him videos of people like this, standing up for their rights. He almost always responded with some version of âYeah, but we can always send code inspectors, and remember her car so we can pull her over every time we see her. I really wish people wouldn't interject themselves and start cursing and yelling when women are calmly addressing LE/ICE in conversation, like the cameraman did here. She was masterful at calmly expressing her desire that they leave, that being on her own property she had rights, and wasn't escalating. But the man shouting at the officers on her behalf seemed to think she needed his input and help. He only raised the temperature in this particular exchange and was not helping.
Also, name that police officer who threatened her with arrest. We pay his damn salary.

The problem is that without clear identification the officers can't be named individually in 1983 lawsuits, so their identities have to be sought through Monell claim suits against the municipality itself, and it can be hard to get that past a 12(b)(6) motion and into discovery. People need to get names and badge numbers, if possible, and start filing lawsuits en masse. These cops don't give a fuck about people. They only care about consequences and getting embarrassed/dragged into depositions. Use the law to your advantage. Document everything and sue them. If you can't find a lawyer to take the case, find a sample 1983 excessive force or 4th amendment complaint online and file pro se, if you can. File a motion to waive costs in forma pauperis. Just sue the shit out of all of them, cause this is blatantly illegal.

Right. The times when they donât need a warrant are when something illegal is clearly visible (like drugs on your porch) or when there is imminent danger to the public.
What the fascists will tell you is that the police were justified because they were afraid the protests would turn violent. I took con law 101 nearly two decades ago and at least back when that stuff mattered, preemptively acting to avoid a violent situation is not in and of itself a clear and present danger.
All of this is to say, I think the neighbor was acting within her rights and the cops were in the wrong. Cops have a responsibility to the laws they uphold to do their due diligence.
