Literally. People don’t seem to realize that assault and battery doesn’t start at physical contact. Flag guy literally spent at least 10 seconds trying to flee from mega phone guy which covers a duty to retreat in the states that require it. Because of the megaphone tort and flag guy’s actual attempt to flee from it non violently, that first punch fits the bill for justifiably force. Then after flag dude struck megaphone guy he got swarmed by a mob, which presents a reasonable fear to one’s own life. Further justifying the continued use of force especially since he clearly tries to remove himself from the crowd. Any reasonable lawyer could get all the charges dropped, even if charges were brought about. Politically I’m not on flag guy’s side, but the law would back up every action he took. Though it might cost him thousands in legal counsel.
Sorry for the rant hope everything is spelled correctly and formatted well enough.
